여기에 『민사판례연구』 제29집을 펴냅니다. 저희 민사판례연구회는 지난해에도 전과 다름없이 월례 연구발표회를 10회에 걸쳐 행하였고, 여름에는 「보험법의 제문제」를 주제로 해서 심포지엄을 가졌습니다. 이 책은 이들 모임에서 발표된 원고에 보완․수정을 가한 것을 모은 것입니다.

이번의 제29집은 心堂 宋相現 선생님의 停年紀念號로 발간됩니다. 선생님께서는 창립회원으로서 우리 연구회의 발전을 위하여 진력하셨을 뿐만 아니라, 특히 1990년 8월부터 2004년 12월까지 만 14년이 넘는 참으로 긴 세월 동안 회장으로서 우리 연구회를 이끌어 주셨습니다. 저희는 선생님께서 언제까지나 저희 곁에 계셔서 따뜻한 가르침과 북돋음을 주실 줄로만 믿고 있었으나, 누구도 거부할 수 없는 세월의 힘으로 선생님께서는 올해 2월 말로 서울대학교 법과대학을 정년으로 퇴임하신 것입니다. 그러나 선생님께서는 전과 조금도 다름 없이 눈부시게 빛나는 삶을 사시고 또 국제적인 명성을 누리고 계시기 때문에, 선생님께는 어울리지 않는 정년이라는 것과 결부된 무슨 일을 굳이 마음에 둘 필요가 있을까 하는 생각이 들지 않는 것도 아닙니다. 그렇지만 저희는 이 기회를 빌어서 선생님의 우리 연구회에 대한 열정과 정성, 그리고 기여를 오래 기리고자 하는 뜻을 담아 이번의 제29집을 선생님의 정년기념호로 꾸미기로 하였습니다. 선생님께서 앞으로도 변함없이 저희들을 지도하여 주시고, 커다란 업적을 계속 쌓으시며, 사모님과 함께 늘 건강하시고 댁내에 만복이 깃들이기를 기원합니다.

이 책의 발간에 수고하여 주신 박영사의 여러분께 이 자리를 빌어 감사의 말씀을 드립니다.
